These Terms of Service, also referred to as the General Terms and Conditions of Sale, govern access to kindmear.com and purchases made from SCI BOWL VAR.

By browsing the website, creating an account, submitting an order, or using our services, you agree to these Terms of Service and to the policies incorporated into them by reference.

These terms apply to consumers purchasing products for personal use. Mandatory rights granted under French and European Union consumer law remain unaffected.

Before submitting an order, you must review these terms and confirm your acceptance through the checkout process. You should save or print a copy for your records.

If you do not agree with these terms, you should not submit an order. Separate written terms expressly agreed between us and a customer may take priority over the relevant part of these terms.

3. Eligibility to Purchase

To place an order, you must have the legal capacity to enter into a binding contract. Customers under the age of legal majority should place an order only with the involvement and permission of a parent or legal guardian.

You must provide accurate, current, and complete information during checkout and must be authorised to use the selected payment method.

Products purchased through the website are intended for lawful personal use and not for unauthorised commercial resale.

4. Products and Product Information

We aim to describe products accurately through titles, descriptions, specifications, dimensions, materials, photographs, and other information displayed on the relevant product page.

Product colours and appearance may vary slightly depending on screen settings, lighting, manufacturing batches, materials, and photographic presentation. Minor differences that do not affect conformity or normal use are not necessarily defects.

The checkout page allows you to identify and correct information before the order is submitted. Once submitted, certain changes may no longer be possible.

7. Order Confirmation and Contract Formation

After an order is submitted, we normally send an electronic acknowledgement to the email address provided during checkout.

An automated acknowledgement confirms that we have received the order but does not necessarily mean that the order has been finally accepted. The sales contract is formed when we expressly accept the order or dispatch the products, depending on the order process used.

8. Order Acceptance and Cancellation by the Seller

We may refuse, suspend, or cancel an order where reasonably necessary, including where:

If an order is cancelled after payment has been collected, the affected amount will be refunded to the original payment method unless another method is legally required or agreed.

9. Payment Terms

Payment must be made using one of the methods displayed during checkout. Available methods may include payment cards, digital wallets, or other services supported for the relevant order.

Payment may be processed by an authorised third-party provider. Your bank or payment provider may require additional authentication before approving the transaction.

You confirm that the billing information supplied is correct and that you are authorised to use the selected payment method.

10. Shipping and Delivery

Orders are dispatched from France. We currently deliver to supported destinations in Europe, the United States, Canada, and other international regions.

Orders are normally processed within 1–2 business days. Estimated shipping times begin after processing and vary according to the destination and carrier.

Shipping fees, estimated transit times, customs information, tracking, delayed deliveries, and damaged parcels are explained in our Shipping Policy.

Delivery estimates are not guaranteed dates. However, we remain responsible for complying with mandatory delivery obligations under applicable consumer law.

11. Customs and International Orders

Orders delivered outside the European Union may be subject to customs procedures, import taxes, duties, brokerage charges, or local handling fees.

Unless checkout expressly states that these charges are included, they may be collected separately from the recipient by customs authorities, carriers, or local delivery providers.

Customers are responsible for reviewing the import restrictions and requirements applicable in the destination country. We may cancel an order if delivery would violate applicable law or carrier restrictions.

12. Right of Withdrawal and Returns

Eligible consumers generally have a statutory right to withdraw from an online purchase within 14 calendar days after receipt of the goods, subject to lawful exceptions.

In addition to the statutory period, SCI BOWL VAR offers an extended commercial return period of up to 30 calendar days after delivery for eligible products that meet the stated return conditions.

Nothing in our commercial return policy reduces mandatory rights available under French or European Union law.

13. Refunds

Approved refunds are normally issued to the original payment method. We generally process an approved refund within 7 business days after the returned product has been received and inspected.

Where a statutory withdrawal applies, reimbursement will be made within the legally required period. We may withhold reimbursement until the returned goods are received or evidence of return shipment is supplied, where permitted by law.

Your bank or payment provider may require additional time to display the refunded amount after it has been issued by us.

14. Legal Guarantee of Conformity and Hidden Defects

Consumers purchasing products in France benefit from mandatory legal guarantees, including the legal guarantee of conformity and the legal guarantee against hidden defects where their legal conditions are met.

These guarantees apply independently of our 30-day commercial return period and any voluntary warranty that may be offered.

Depending on the circumstances and applicable law, available remedies may include repair, replacement, price reduction, cancellation of the sale, reimbursement, or another legally required remedy.

You must not:

Subject to mandatory law, we are not responsible for losses caused by customer misuse, failure to follow product instructions, inaccurate information supplied by the customer, unauthorised account access caused by inadequate credential protection, or events outside our reasonable control.

Any limitation in these terms must be interpreted consistently with the mandatory protections available to consumers.

18. Complaints and Consumer Mediation

If you have a complaint, contact us first so that we can attempt to resolve the issue directly.

If a consumer dispute cannot be resolved after a prior written complaint, you may have the right to refer the matter free of charge to the consumer mediator appointed by SCI BOWL VAR.

A mediation request remains subject to the mediator's eligibility, timing, and procedural requirements. The customer must normally first attempt to resolve the complaint directly with us in writing.

The mediator information above must be completed with the details of a French consumer mediator that is officially referenced and competent for our business sector before this page is published.

19. Governing Law, Changes, and Contact

These terms are governed by French law, without depriving consumers residing in another country of any mandatory protections available under the law of their habitual residence.

Any dispute should first be addressed through our customer-service and consumer-mediation procedures. Where an amicable solution cannot be reached, either party may refer the dispute to a court having jurisdiction under applicable law.

We may update these terms to reflect changes to our business, website, products, services, providers, or legal obligations. The version accepted when an order is placed generally governs that order, subject to mandatory law.

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
